HOOPSTARS Privacy policy

Thank you for visiting Hoopstars (or “we” or “our”). This Privacy Policy describes the personal data handling policies of Hoopstars in connection with its online application (the “App”) and website at www.thehoopstars.com (the “Website” and together with the App, the “Services”), including the following:

1. Use of the App By Children;
2. What personal data we collect;  
3. How we use the data;
4. With whom we may share the personal data;
5. Grounds for using personal data;

For purposes of this Privacy Policy, the term “you” or “your” refers only to parents, legal guardians and other adult users.

1. Use of the App by Children

Subject to the laws of your country of residence, minors (a “Child” or “Children”) may utilize the App through an account established by a parent or legal guardian (hereinafter referred to as “Parent”).

In accordance with the requirements of the U.S. Children’s Online Privacy and Protection Rule (“COPPA”), Hoopstars seeks verifiable Parental consent of the use of the App by a child under 13 through methods approved under applicable law.  We may (a) ask the Parent for payment card information; (b) contact the Parent with an email address or other contact information supplied by the Child to confirm, refuse or modify his/her Child’s registration; and/or (c) ask the Parent to provide 0additional documentation or perform additional actions as part of the approval process as consistent with applicable law. Hoopstars reserves the right to refuse access to the App pending confirmation and activation by the Child’s Parent. In addition, Hoopstars reserves the right to ask for written proof of Parental consent for any user or potential user of the App we suspect is a minor. Use of the App by Children must take place under the responsibility of their Parent, and any use of the App is assumed to have been validated by them.

Under the European Union’s General Data Protection Regulation (“GDPR”), if a user is under the age of 16 (or under 13 in the United Kingdom), we require Parental authorization for data collection and account creation. We will also treat teen users aged 13-15 as minors under global privacy laws. Children may exercise their data subject rights under GDPR (see Section 7 below for a detailed review). These rights include the right to know how we use and share your information, the right to correct, change or delete your information, the right to change your mind about providing your data, the right to have a copy of your data, the right to not be profiled, and the right to complain to a governmental privacy authority.

We do not use third‐party analytics or advertising in the App, and we do not share any personal data (such as name, age, email or device identifiers) with third parties. Any analytics used in the App are for internal use only and are in an aggregated form (i.e., not collecting IDFA/AAID or other persistent IDs).

The App does not collect precise location or device identifiers (e.g. IMEI, Android ID, advertising ID, MAC address, etc.) from child users. We do not request location permission in the App.

Children use the App through an account created by their Parent. We adhere to the principle of data minimization and collect only what is reasonably necessary for the Child’s use of the App.

A parental gate is used before enabling any free-form chat or information exchange.

We share a Child’s personal data only with service providers who assist us in the provision of the App and strictly under contract (e.g., hosting, payment processors) and with the child’s Parent. We do not disclose Children’s personal information to unrelated third parties.

Parents can review and delete their Child’s data and prevent further collection at any time. Parents can contact us by email at privacy@thehoopstars.com.  Hoopstars will respond to any such request promptly and endeavor to delete requested data within 30 days of the request as recommended by FTC guidance.

In the event that you permit your Child to use the App, you agree on behalf of yourself and your Child to our data handling practices as described in this Privacy Policy.

In the event we discover we have collected information from a Child in a manner inconsistent with COPPA’s or GDPR’s requirements (as applicable), we will delete the information immediately.

2. Personal Data We Collect or Process

(a) By using the Website (which is informational and not directed towards Children) or by registering an “Adult” or “Parent” account, you represent that you are at least 18 years old and that you are of legal age to enter into legal agreements. 

(b) The App does not use cookies or web beacons, but rather uses a technology called Async Storage that is supported by the React Native library (@react-native-async-storage/async-storage ). The App will hold data temporarily on the device as necessary for the user's action. For example, where the App offers a quiz, the App will store the user's answer until the final quiz result so that it can be saved to the database.

(c) The Website captures some information about you automatically utilizing background local storage and session storage technologies (“Cookies”). Cookies are small files or other pieces of data which are downloaded or stored on your computer or other device, that can be tied to information about your use of the Website (including certain third party services and features offered as part of our Website). Examples of information of this type are your IP address, the browser you are using, information about your network and device, the operating system you are using, the Internet pages you visited prior to coming to our Website, the pages on the Website that you visit and details of your browsing activity on our Website (such as your clicks, internal pages visited, searches and timestamps).  When we use Cookies, we may use “session” Cookies that last until you close your browser or “persistent” Cookies that last until you or your browser delete them. You may change your browser setting to decline the use of Cookies.

(d) We operate social media pages on third party networks and have social media icons on our Services. When you visit or link to our social media pages, data is processed both by us and the applicable social media provider. Social media providers are unaffiliated with us, and we are not responsible for the content or privacy practices of social media providers.  Social media providers have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms.

(e) The Services also collect information that you provide to us voluntarily, including, without limitation, when you:

· Sign up to receive newsletters, announcements and invitations
· Purchase and download the App
· Register an account
· Upload content, such as photos and videos
· Interact with other users of the App, such as liking/commenting on other users’ content
· Contact us by email.

Users will be asked for name, birth date, email address, phone number, username, profile picture, and if you purchase a subscription, your payment card information and billing address. Please note that your username and profile picture may be visible by other users. 

(f) The Website is an informational and marketing website only and is not directed towards Children. We do not knowingly collect information from users of our Website under the age of 18 and/or their internet usage, and such persons are not authorized to use the Website.

3. How We Use the Data

We use the personal data we collect to respond to inquiries, administer the Services, fulfill subscription orders, enhance our Services, provide updates and other important information related to your (and/or your Child’s) activity on and with the Services, inform you of new services or changes in Services, enter into contracts for services, to fulfill legal obligations we have to governmental authorities or other third parties, and for other legitimate business purposes. You will have the opportunity to opt out of any electronic marketing communications you may receive from us.

Please note that if you provide a mobile phone number, you are consenting to receive text messages from us for authentication purposes. You will have the opportunity to opt out of any text messaging communications you may receive from us.

We may use birthdate information to send birthday greetings or a special birthday promotion.

4. With Whom We Share Personal Data

In order to provide the Services, Hoopstars shares your personal data with third parties who perform services on our behalf, including without limitation our App developer, technology providers, payment processors, analytics providers, electronic communication providers and professional advisors.  Hoopstars’ relationship with such third parties is contractual in nature, as each such third party is a third-party vendor to Hoopstars, and they are not subject to Hoopstars’ direction or control; thus, the relationships are not, and should not be construed as, one of fiduciaries, franchisors-franchisees, agents-principals, employers-employees, partners, joint venturers or the like.

We may disclose information if we have a good faith belief that disclosure is necessary by law or the legal process, to protect and defend our or others’ interests or property, or to enforce agreements you enter into with us. 

We may share personal data with a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock with such third party.

We may share aggregated and de-identified information with third parties for analytical, research or other similar purposes.

We may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the Services, including for any other contemplated uses of your personal data not addressed in this Privacy Policy. Please read all online agreements carefully before accepting them. 

5. Grounds for Using Personal Data

We rely on the following legal grounds to process personal information:

Consent. Some uses of personal data as described in this Privacy Policy are subject to consent, such as marketing communications.  To withdraw consent, please contact us at privacy@thehoopstars.com. 

Performance of a contract. We may need to collect and use personal information to enter into contracts with our users and to perform Services that users request. 

Legitimate Interests. We may use personal information for our legitimate interests to provide our Services and to improve our Services and the content contained thereon.  We may use technical information as described in this Privacy Policy and use personal information for our marketing purposes consistent with our legitimate interests and any choices that we offer or consents that may be required under applicable law. 

Compliance with Legal Obligations. We may use personal information as necessary to comply with our legal obligations.

6. Storage and Protection of Your Personal Data

We retain the personal data we collect for so long as reasonably necessary to fulfill the purposes for which the data was collected and to perform our contractual and legal obligations. Notwithstanding the generality of the foregoing, we store email addresses and phone numbers until the user requests their information to be removed from our systems. 

Hoopstars does not collect or store payment card information; rather we utilize payment processors and store only an electronic receipt that sets forth confirming payment details, such as purchase date, the expiration date of the payment card and the payment ID, but not complete payment card information.

We take reasonable administrative, physical and technical precautions to protect personal data and communications between us.  This includes, when required or as we deem appropriate and feasible under the circumstances, encryption and written commitments from third parties that may have access to personal data that they will protect the data with reasonable safeguards that are substantially equivalent to those used by us. 

No Internet or e-mail transmission is ever fully secure or error free, however.  We therefore cannot guarantee absolute security of your data, and we are not responsible for processes and networks that we do not control.  Users assume the risk of security breaches and the consequences resulting from them.  Users should use caution about information sent to us via email or over the Internet. 

7. Privacy Rights, Choices and Disclosures

(a) General. This section is subject to specific disclosures on privacy rights set forth below. We are committed to facilitate the exercise of privacy rights granted by the laws of a user’s jurisdiction, which may include the right to request the correction, modification or deletion of personal information and the right to opt out of the sale of personal information (as applicable). We will do our best to honor user requests subject to any legal and contractual obligations.  To make a request, cancel an account or request we delete or no longer use account information to provide Services, contact us at privacy@thehoopstars.com or make changes to any user profile information connected to the account.

 You may opt out of receiving electronic marketing communications from us by clicking on the “unsubscribe” link on the communication or contacting us at privacy@thehoopstars.com. Some non-marketing communications may not be subject to a general opt-out, such as communications about transactions, disclosures to comply with legal requirements and support-related information. 

Subject to local law, users may have additional rights under the laws of their jurisdiction regarding personal data, such as the right to complain to your local data protection authority.

You may be able to disable Cookies through your browser settings, but if you delete or disable Cookies, you may experience interruptions or limited functionality in certain areas of the Services. 

(b)   Your European Privacy Rights and Choices.  The privacy rights of users located in the European Union, the United Kingdom or another jurisdiction that has adopted laws substantially similar to GDPR, are as follows:

·  Transparency and the right to information. Through this policy we explain how we use and share personal information. However, users can submit questions or request additional information at any time by contacting us at privacy@thehoopstars.com.

· Right of access, correction, restriction of processing, erasure. Users may contact us to request information about the personal data we have collected from them and to request the correction, modification or deletion of such personal information, which requests we will do our best to honor subject to any legal and contractual obligations. 

· Right to withdraw consent at any time. When we process personal data based on consent, consent can be withdrawn at any time.

· Right to object at any time. Users have the right to object at any time to receiving marketing or promotional materials from us by either following the opt-out instructions in commercial e-mails or by contacting us, as well as the right to object to any processing of personal data based on the user’s specific situation. In the latter case, we will assess the request and provide a reply in a timely manner, according to our legal and contractual obligations.  Some non-marketing communications are not subject to a general opt-out, such as communications about transactions and disclosures to comply with legal requirements. 

· Right to data portability. Users have the right to data portability of their own personal data by contacting us.

· Right not to be subject to an automated decision, including profiling. We do not make automated decisions using personal data that may negatively impact the user.

· Right to lodge a complaint with a supervisory authority. If users consider that the processing of their personal data infringes their privacy rights according to applicable law, users have the right to lodge a complaint with a supervisory authority, in the member state of the users’ habitual residence, place of work, or place of the alleged infringement.

(c) California Disclosures

California “Shine the Light” Information-Sharing Disclosure: California residents may request a list of all third parties with respect to which we have disclosed any information about you for direct marketing purposes and the categories of information disclosed.  If you are a California resident and want such a list, please send us a written request by email to privacy@thehoopstars.com with “California Shine The Light Rights” in the subject line. 

California Do Not Track Disclosure: The App is native on your device and does use any web browsing features.  The Website does not respond to “Do Not Track” browser signals.

California Consumer Privacy Act. Hoopstars is not a “business” as defined under the CCPA and therefore not subject to CCPA.

8. Users Outside the United States

The Services are controlled and operated from the United States. For users from the European Union, Canada or any other jurisdiction with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that we may store the information we collect in the United States which is not deemed an “adequate jurisdiction” by the European regulatory authorities.  Personal data may also be transferred from the country of the user’s residence to other countries, including the United States.  By visiting or using our Services, users are consenting to the transfer of their information from their jurisdiction to the United States.

9. Links to Other Sites

Our Website may contain links to other websites for your convenience or information.  These websites may be operated by companies unaffiliated with Hoopstars, and we are not responsible for the content or privacy practices of those websites.  Linked websites may have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit the websites. 

10. Privacy Policy Changes

We may update this Privacy Policy from time to time and without prior notice to reflect changes in our information practices, and any such amendments shall apply to information already collected and to be collected. A user’s continued use of the Services after any changes to our Privacy Policy indicates agreement with the terms of the revised Privacy Policy.  Please review this Privacy Policy periodically and especially before providing personal data to us.  The date of the last update of the Privacy Policy is indicated at the top of this Privacy Policy.
